The days following a loved one’s passing are stressful enough, but having to validate their last will and testament can add on top of an already emotional period.

What is probate?

If you’re applying for a grant of probate, you’re seeking legal permission to carry out the wishes of a loved one’s will. Overall, though, the term probate is usually applied to the whole process of administering an estate, from getting permission from court to distributing the assets.

What happens during the process?

Last wills and testaments vary from person to person. But while assets or wealth may be treated differently, the probate process remains largely the same.

If you’re named in the will to manage the person’s estate you are the executor. That means you’ll be responsible for gathering all the information on the estate’s assets and debts. You’ll then apply for a grant of probate, complete an inheritance tax return, and finally, once you receive the grant of probate, settle any debts and distribute the estate in accordance with the will.

The process can take up to a year, but can take longer depending on the complexity of the estate.

If there is no will, you will have to prove your legal right to manage the estate with letters of administration.

How to apply for probate

To apply for probate, you have two main options:

  • apply for probate online or via post
  • employ a probate practitioner.

You can apply for probate online via the HMRC website. Before applying, though, you must have an estimated value of the estate to find out whether there is any inheritance tax left to pay.

If you do report the estate to HMRC before applying, you must pay any inheritance tax due and wait 20 days after sending tax forms to HMRC.

How to track your application

Thankfully, once you have submitted an application for probate, you don’t have to sit around and wait for any updates. You can track your application online through the Government website.

After applying, you will be given login details, giving you access to live updates from the probate service. If you do decide to pay for probate services, your service provider will also be able to track and give you updates on the grant process.
